Israel and International Law
So, let’s consider international law. If Israel is to be recognized any rights at all, then it should start with recognizing international law. Israel, therefore, should recognize the right of the Palestinian people to self-determination.
The Israeli record on ignoring international law is second to none. Israel has been breaking any and all international laws, dozens of United Nations resolutions and binding UN Security Council resolutions. Israel is a criminal state and should be treated as such. In 2022 alone, Israel broke all records and was concerned by 15 UN resolutions (against 6 for Russia, despite the war in Ukraine that started that year). Lately, Israel has broken international and marine law, capturing the Madleen ship from the Freedom Flotilla in international waters, even kidnapping all the people on board, including an elected deputy at the European Parliament: Israel will stop at nothing and won’t respect anyone nor anything getting in their way.
Yet, the State of Israel was created by international law: if we, the rest of the world, were to act like Israel did since its inception, we would only have to ignore one single non-binding UN resolution, 181 (II) from 1947 and Israel would cease to exist.

- Geneva Conventions IV, Article 49(6) (1949). It is illegal to colonize occupied land or transfer non-indigenous population to that land.
- Forbidding civilian populations the right to return to their homes following the end of armed conflict is in direct violation of international law and UN resolutions. - Israel has violated (by 2018) 30 resolutions of the United Nations Security Council (which are legally binding on member-nations U.N. Charter, Article 25 (1945); a few sample resolutions - 54, 111, 233, 234, 236, 248, 250, 252, 256, 262, 267, 270, 280, 285, 298, 313, 316, 468, 476, etc.
- International Court of Justice of 2004, in an advisory opinion, ruled the Israeli separation barriers illegal. They condemned the separation wall Israel is building throughout the occupied West Bank in a 14 to 1 ruling. The Court begins by citing, with reference to Article 2, paragraph 4, of the United Nations Charter and to General Assembly resolution 2625 (XXV), the principles of the prohibition of the threat or use of force and the illegality of any territorial acquisition by such means, as reflected in customary international law. It notes that significant amounts of land are de facto annexed by the separation barrier. It further cites the principle of self determination of peoples, as enshrined in the Charter and reaffirmed by resolution 2625 (XXV). As regards international humanitarian law, the Court refers to the provisions of the Hague Regulation of 1907, which have become part of customary law, as well as the Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War of 1949, applicable in those Palestinian territories which, before the armed conflict of 1967, lay to the east of the 1949 Armistice demarcation line (or “Green Line”) and were occupied by Israel during that conflict. The Court further notes that certain human rights instruments (International Covenant on Civil and Political Rights, International Covenant on Economic, Social and Cultural Rights and the United Nations Convention on the Rights of the Child) are applicable in the Occupied Palestinian Territory. It finds that the construction of the wall and its associated régime are contrary to the relevant provisions of the Hague Regulations of 1907 and of the Fourth Geneva Convention; that they impede the liberty of movement of the inhabitants of the territory as guaranteed by the International Covenant on Civil and Political Rights; and that they also impede the exercise by the persons concerned of the right to work, to health, to education and to an adequate standard of living as proclaimed in the International Covenant on Economic, Social and Cultural Rights and in the Convention on the Rights of the Child. Lastly, the Court finds that this construction and its associated régime, coupled with the establishment of settlements, are tending to alter the demographic composition of the Occupied Palestinian Territory and thereby contravene the Fourth Geneva Convention and the relevant Security Council resolutions.

What should happen now
1. Immediate ceasefire in Gaza
The genocide must end immediately. Israeli troops must be sent home.
The humanitarian aid must be let through the gates and means must be put in place to restore survival conditions in the Gaza strip for hospital to take care of the wounded and the malnourished. The fake humanitarian council from USA and Israel must be dismantled and the United Nations, Red Cross, Red Croissant and other legitimate humanitarian aid organizations must be allowed in Gaza.
2. Surrender of the Israeli army to the UN Blue Helmets
The occupying army of Israel must surrender to the United Nations and be disarmed and dismantled. Officers and soldiers must be condemned for their war crimes and crimes against humanity, according to international law.
3. Place Israel under international trusteeship
With its military dismantled, and its political leaders considered criminals, Israel’s fate should follow that of Germany after World War II. Israel must be place under international trusteeship under UN Blue Helmet control to prevent settlers racist exactions against the Palestinians especially in the West Bank where illegal settlements must be dismantled.
4. Dismantle Israeli military
Israel military must be removed, like the Allies did for the Wehrmacht after WWII. Israel must not be allowed to maintain an army since it uses its armies to aggress neighbouring countries, occupy territories and genocide people, against all international law. Such rogue power must not be allowed to exist anywhere on the planet, as they are jeopardizing the very fabric of a peaceful human society on Earth.
5. Dismantle Zionist brainwashing
When looking at Israeli people, two main variants come to mind: the racist middle-aged person who absolutely hates Palestinians, “do not care” what happens to them, that reflect exactly the kind of mindset that prevailed across Europe in the XXth Century and made Nazism and the Jewish genocide possible ; and then you have the youth, who never knew anything else, and was brainwashed from kinder garden into believing the Arabs are the enemies of Israel, children brought up as paranoid racist idiots who will in turn serve in the army to “defend” Israel… against what?
Zionism makes people believe the State of Israel has a right to exist within the Jewish worldview, but Zionism was created as an antisemitic propaganda regarding the Jews as a failed people to be reformed into a modern, areligious people. Zionism claims that being a Jew is being a national of Israel, yet the Jews existed for thousands of years before the State of Israel, across the world, in all countries, where they have been living among other citizens of their countries. Religious Jews believe that Israel is a promised land, and not a homeland, and it belongs to God to grant them the privilege, not to humans, not to weapons. Zionism is antithetical to Judaism and abuses Judaism to promote its imperialist and military ambitions.
6. Remove all illegal occupation from Palestine
If Israel is to be recognized any rights at all, then international law must be applied. All the occupation of the West Bank should be removed, and Israel should pay for the damages it has caused across and beyond the Palestinian territory, across all Middle-East.
If Christians believe the second coming of Christ will come from Israel, then they should realize that funding Zionism is not exactly helping propagating the message of love of their messiah.
7. Judge and condemn Netanyahu and his team for their crimes
If Israel is to be recognized any rights at all, then international law must prevail. Therefore the heads of Hamas and of Israel must be judged, all of them, for war crimes and crimes against humanity. Actually, all their accomplices should be judged as well: all country leaders who have been hosting and helping the war criminals, ignoring the arrest warrants against them.
8. Let Palestinians and willing Israeli rebuild
I want to believe that there are people in Israel who are ready to live in peace with the Palestinians and who are not brainwashed, not racist and not complete fascist and barbarians. Over the course of 77 years of occupation, of course people were born on this land who do not know any other home. I want to believe that among them, some are ready to acknowledge the brainwashing ideology of Zionism and the fact their parents or grand-parents stole the homes of Palestinians and voluntarily displaced them and destroyed their culture, appropriated their land. This is important that Israelis born in Palestine can remain there if they are willing to consider Palestinians as their equals. One cannot erase generations of lives born there: yet this is what Israel has done, and this is wrong. Certainly there are opportunities for some Israelis to remain there and rebuild alongside the Palestinians, as brothers and sisters. It is important, critical indeed, that the Palestinians can rebuild their homes and remain in their land, recover what was stolen from them. This won’t be easy for both people.
As Ghada Karmi wrote in 2008:
A different approach that puts the principles of equity and sharing above dominance and oppression is needed: a one-state solution. In such a state, no Jewish settler would have to move and no Palestinian would be under occupation. Resources could be shared, rather than hoarded by Israel. Jerusalem could be a city for both. Above all, the dispossessed Palestinians could finally return home.
This is the end of Israel, the oppressive and belligerent military power. This is the beginning of Palestine-Israel, a single territory for all the living, a territory that racists and fascists must leave and let live.
9. Expose and stop racism, colonialism, imperialism
Any of these points would be invalid if we were to ignore the racist roots of Israel in Palestine. There are more Christian zionists in the world than Jewish zionists. Christians zionists and antisemitic evangelists have been supporting Israel, so Jews can have a home away from them.
Israel claims to be the homeland of Jews, but this is false. Many Jews are anti-zionist and support the Palestinian cause. The zionist project is racist and colonialist and supported by imperialist interests of the USA and Europe.
As long as we do not recognize the imperialism of our own countries, which is the continuation of colonialism, delegated to Israel, we cannot understand nor stop the situation in Palestine, because we are supporting the genocide that we delegated to Israel.
Europe and the USA are falling to the fascists because we let their nauseous ideas prevail. The genocide of Palestinians is the result of our inaction facing racist ideology elsewhere.
